Chapter 3 - The Custody Trap

Three days later, Elena checked out of St. Jude’s Hospital and moved directly into a high-security serviced apartment downtown, paid for out of her personal, pre-marital bank account that the Howard family had been unable to touch.

The living room was quiet, flooded with soft afternoon sunlight that drifted through floor-to-ceiling windows overlooking the river.

Sitting across from Elena at the glass dining table was Eleanor Vance, the city's most formidable family law attorney. Eleanor was sixty years old, with sharp silver hair cut into an immaculate bob, tailored grey suits, and a reputation for dismantling wealthy deadbeat husbands in court.

"The criminal charges against Vanessa Cole are proceeding," Eleanor said, laying out a series of legal briefs across the glass. "Second-degree assault on a pregnant person, recklessly endangering the welfare of a child, and filing a false police report. She’s currently out on a two-hundred-thousand-dollar bond, but her legal team is panicked."

"What about Margaret?" Elena asked, sipping her chamomile tea.

"Margaret is being investigated for conspiracy to commit assault and obstruction of justice," Eleanor explained. "However, her legal team is spinning the audio record. They claim she was merely reacting in the heat of the moment to what she genuinely believed was an altercation between you and Vanessa."

"And my husband?"

Eleanor sighed, setting down her gold fountain pen. "Daniel is playing his cards very carefully. Yesterday morning, his corporate lawyers filed a preemptive civil petition in family court."

Elena’s hand tightened around her teacup. "What kind of petition?"

"An application for emergency sole legal and physical custody upon the birth of the child," Eleanor said flatly. "Coupled with a request for a mandatory court-ordered psychiatric evaluation for you."

"On what grounds?" Elena’s voice was dangerously quiet.

"They are using Dr. Harrison's falsified medical records," Eleanor revealed. "Even though Harrison is currently under investigation by the state medical board, his formal filings were submitted before the police search warrant was executed. Daniel’s team is arguing that you are suffering from severe paranoia, that you staged the fall at the stairs to frame his family, and that you are an unfit mother who presents an immediate danger to the unborn child."

Elena felt a cold spike of rage settle deep in her chest. She set her teacup down with a deliberate, soft tap. "He thinks he can use his family's money to buy the court."

"The Howard name carries immense weight in this jurisdiction," Eleanor warned. "Judge Miller, who has been assigned to the preliminary custody hearing next Tuesday, was appointed during Daniel's father's tenure on the state judicial board. He is old money, traditional, and tends to favor established family structures unless handed undeniable, irrefutable proof of malice."

"I have the offshore financial records," Elena pointed out. "I have the apartment lease for Vanessa."

"Financial infidelity and marital misconduct are useful in divorce proceedings, Elena," Eleanor said gently. "But in an emergency custody hearing regarding an unborn infant, judges care about one thing: the physical and psychological safety of the child. If Daniel can convince Judge Miller that you are mentally unstable and that the fall was a result of your own erratic behavior, he will be granted temporary custody at birth."

Elena stood up slowly, her hand resting on her stomach. She walked over to the floor-to-ceiling window, looking down at the tiny cars crawling along the boulevard below.

"They think I'm weak because I stayed quiet for so long," Elena said softly. "They thought because I came from a small-town background without a massive empire behind me, I would fold the moment they threatened to take my baby."

"What are you thinking, Elena?" Eleanor asked, watching her closely.

Elena turned around, her face illuminated by the bright sky. "Daniel doesn't care about the baby. He cares about the child's trust fund. Under my father's will, the twenty-million-dollar land development trust passes directly to my firstborn child upon birth—with me as the sole trustee. But if I am declared legally incompetent, the trust administration falls to the child's legal guardian."

Eleanor nodded grimly. "Which would be Daniel."

"Exactly," Elena said. "This was never about a failing marriage or a mother-in-law who disliked her daughter-in-law. This was a corporate takeover executed inside a bedroom."

She walked back to the table, her eyes clear and unyielding.

"Call Detective Ruiz," Elena instructed her lawyer. "Tell him we need to trace the payments made to Dr. Harrison's personal accounts over the last six months. Don't look at Daniel's primary accounts. Look at the Howard Family Foundation's charitable arm."

Eleanor’s eyes lit up with professional appreciation. "A tax-exempt foundation paying off a private physician?"

"Margaret runs the foundation's accounting," Elena said with a cold smile. "She always told me that the best way to hide a bribe is to call it a medical research grant. Let's see how Judge Miller feels about Daniel's family when his mother is facing federal wire fraud charges."
